Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Purush Shakti mobile application and related services (collectively, the "Service") operated by Jeet Gosawmi, a sole proprietor based in Ahmedabad, Gujarat, India ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872, to use this Service. The App is rated 17+ (Mature) and is intended only for adult users.

2. Description of the Service

Purush Shakti is a wellness and educational application for Gujarati-speaking adult men. It provides:

• Pelvic floor and breathing exercise guidance
• Yoga asana instructions and demonstrations
• Meditation and pranayama practices
• Cultural and educational content including Vatsyayana's 64 Kala framework
• Diet and lifestyle articles
• Personalized practice plans based on user-provided information

3. Account and Anonymous Use

You may use the Service anonymously without providing personal information. You may optionally provide a phone number, email, and name for subscription management and cross-device synchronization. You are responsible for keeping your account credentials confidential and for all activities that occur under your account.

4. Subscription Plans and Billing

The Service offers a 7-day free trial followed by paid subscriptions at the following prices (inclusive of applicable GST):

4.1 Auto-Renewal Disclosure

All subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your payment method on file with Razorpay or Google Play will be charged automatically. You can cancel anytime — see our Cancellation Policy.

4.2 Free Trial

The 7-day free trial begins when you first subscribe. You will NOT be charged during the trial. If you do not cancel before the trial ends, your subscription will start automatically and your payment method will be charged the plan amount. To avoid charges, cancel before the 7th day.

4.3 Price Changes

We may change subscription prices from time to time. Price changes will not affect your current billing cycle. We will notify you at least 30 days before any price increase takes effect, and you may cancel before it does.

5. Refunds

Please see our Refund Policy for full details. Briefly: no refunds for partial billing periods except in cases of technical errors, duplicate charges, or fraud.

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of any applicable Indian law
• Copy, modify, distribute, sell, or lease any part of the App or its content
• Reverse-engineer, decompile, or attempt to extract the source code
• Share your account credentials or allow others to use your subscription
• Use automated means (bots, scrapers, etc.) to access the Service
• Upload or transmit malware, viruses, or harmful code
• Impersonate any person or misrepresent your identity
• Interfere with the operation or security of the Service
• Use the Service to harass, abuse, or harm others

7. Intellectual Property

All content in the App — including text, articles, audio narration, video instruction, illustrations, the 64 Kala interpretations, design, code, and brand elements — is owned by Purush Shakti (Jeet Gosawmi) or licensed to us. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only.

Traditional knowledge (Vatsyayana's Kamasutra, Ayurvedic practices, yoga, pranayama) is part of India's cultural heritage and is not owned by anyone; however, our specific selection, organization, translation into Gujarati, and presentation of this material is our copyrighted work.

8. Third-Party Links and Services

The App may contain links to third-party websites or services, including the Rasayanam store. We are not responsible for the content, terms, or privacy practices of third parties. Any purchases on third-party sites are governed by their own terms.

9. Limitation of Liability

To the maximum extent permitted by Indian law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, consequential, special, or punitive damages.
• Our total liability for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.
• We are not liable for service interruptions caused by factors outside our reasonable control (force majeure).

10. Indemnification

You agree to indemnify and hold harmless Purush Shakti, its operator, and any third-party providers from any claim, loss, or damage (including reasonable legal fees) arising from your breach of these Terms or misuse of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms. You may stop using the Service at any time by cancelling your subscription and uninstalling the App. Sections relating to intellectual property, liability, indemnification, and dispute resolution survive termination.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

13. Dispute Resolution

Before pursuing legal action, both parties agree to attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator in Ahmedabad, in English.

14. Changes to These Terms

We may revise these Terms periodically. Material changes will be notified at least 7 days in advance via the App or email. Continued use after the effective date constitutes acceptance of the revised Terms.

સેવાની શરતો

આ "સેવાની શરતો" (Terms) પુરુષ શક્તિ મોબાઇલ એપ્લિકેશન અને સંબંધિત સેવાઓ (સામૂહિક રીતે "સેવા") ના વપરાશને નિયંત્રિત કરે છે, જે જીત ગોસ્વામી (અમદાવાદ, ગુજરાત, ભારત) દ્વારા સંચાલિત છે ("અમે", "અમારી").

એપ ડાઉનલોડ, ઇન્સ્ટોલ અથવા ઉપયોગ કરીને, તમે આ શરતો સ્વીકારો છો. જો સંમત ન હો, તો સેવાનો ઉપયોગ ન કરો.

૧. પાત્રતા

આ સેવાનો ઉપયોગ કરવા તમારી ઉંમર ઓછામાં ઓછી ૧૮ વર્ષ હોવી જોઈએ અને Indian Contract Act, ૧૮૭૨ હેઠળ કરાર કરવાની કાનૂની ક્ષમતા હોવી જરૂરી છે. એપ ૧૭+ (Mature) rated છે અને માત્ર પુખ્ત વયસ્કો માટે છે.

૨. સેવાનું વર્ણન

પુરુષ શક્તિ એ Gujarati-speaking પુખ્ત પુરુષો માટે wellness અને શૈક્ષણિક એપ્લિકેશન છે. અમે પ્રદાન કરીએ છીએ:

• પેલ્વિક ફ્લોર અને શ્વાસ કસરત માર્ગદર્શન
• યોગ આસનો ની સૂચનાઓ અને demonstration
• ધ્યાન અને પ્રાણાયામ પ્રથાઓ
• વાત્સ્યાયનની ૬૪ કળાઓ સહિતનો સાંસ્કૃતિક અને શૈક્ષણિક content
• આહાર અને જીવનશૈલી લેખો
• User-provided માહિતી પર આધારિત વ્યક્તિગત practice plans

૩. Account અને Anonymous ઉપયોગ

તમે વ્યક્તિગત માહિતી આપ્યા વગર anonymously ઉપયોગ કરી શકો છો. વૈકલ્પિક રીતે, subscription management અને cross-device sync માટે ફોન નંબર, ઇમેઇલ, અને નામ આપી શકો છો. તમારા account credentials ગુપ્ત રાખવા અને account હેઠળ થતી તમામ પ્રવૃત્તિઓ માટે તમે જવાબદાર છો.

૪. Subscription Plans અને Billing

સેવા ૭ દિવસ free trial પછી નીચેના ભાવે paid subscriptions આપે છે (applicable GST સહિત):

૪.૧ Auto-Renewal જાહેરાત

બધી subscriptions દરેક billing period ના અંતે auto-renew થાય છે — જ્યાં સુધી તમે renewal તારીખના ઓછામાં ઓછા ૨૪ કલાક પહેલા cancel ન કરો. Razorpay અથવા Google Play પાસેની તમારી payment method આપોઆપ charge થશે. તમે ગમે ત્યારે cancel કરી શકો — Cancellation Policy જુઓ.

૪.૨ Free Trial

૭ દિવસ free trial પ્રથમ વખત subscribe કરો ત્યારે શરૂ થાય છે. Trial દરમિયાન કોઈ charge નહીં થાય. જો ૭મા દિવસ પહેલા cancel ન કરો, તો subscription આપોઆપ શરૂ થશે અને payment method charge થશે.

૪.૩ ભાવ ફેરફાર

અમે ભાવ સમય સમય પર બદલી શકીએ છીએ. તમારા current billing cycle ને કોઈ ભાવ ફેરફાર અસર નહીં કરે. ભાવ વધારો અમલમાં આવે તેના ઓછામાં ઓછા ૩૦ દિવસ પહેલા તમને જાણ કરવામાં આવશે.

સંપૂર્ણ વિગતો માટે Refund Policy જુઓ. ટૂંકમાં: partial billing periods માટે refunds નહીં, ફક્ત technical errors, duplicate charges, અથવા fraud ના કિસ્સામાં.

૬. સ્વીકાર્ય ઉપયોગ

તમે સંમત છો કે તમે નહીં કરો:

• કોઈ ગેરકાનૂની હેતુ માટે અથવા ભારતીય કાયદાના ઉલ્લંઘનમાં Service નો ઉપયોગ
• એપ અથવા તેના content ની નકલ, modify, વેચાણ અથવા lease
• Reverse-engineer, decompile, અથવા source code કાઢવાનો પ્રયત્ન
• Account credentials શેર કરવા અથવા બીજાને subscription વાપરવા દેવી
• Bots / scrapers દ્વારા automated ઍક્સેસ
• Malware, viruses, અથવા harmful code upload
• કોઈનું impersonation અથવા ઓળખ ખોટી રજુ કરવી
• Service ની security સાથે ચેડાં
• બીજાઓને harass, abuse અથવા harm કરવા માટે Service નો ઉપયોગ

૭. Intellectual Property

એપ ના તમામ content — text, audio, video, illustrations, ૬૪ Kala interpretations, design, code, અને brand elements — Purush Shakti (જીત ગોસ્વામી) ની માલિકીમાં છે. તમને ફક્ત personal, non-commercial ઉપયોગ માટે limited, revocable license મળે છે.

પારંપરિક જ્ઞાન (વાત્સ્યાયન કામસૂત્ર, આયુર્વેદ, યોગ, પ્રાણાયામ) ભારતના સાંસ્કૃતિક વારસાનો ભાગ છે; પરંતુ આ સામગ્રીની અમારી ચોક્કસ પસંદગી, organization, ગુજરાતી translation, અને presentation અમારી copyrighted કૃતિ છે.

૮. Third-Party Links

એપમાં Rasayanam store સહિત third-party websites ની links હોઈ શકે છે. તેમના content, terms, અને privacy practices માટે અમે જવાબદાર નથી.

૯. Liability ની મર્યાદા

ભારતીય કાયદા હેઠળ માન્ય મહત્તમ હદ સુધી:

• Service "as is" અને "as available" પ્રદાન કરવામાં આવે છે, કોઈ warranty વગર
• કોઈ indirect, incidental, consequential, special, અથવા punitive damages માટે અમે જવાબદાર નથી
• કોઈપણ દાવા માટે અમારી કુલ liability છેલ્લા ૧૨ માસમાં તમે અમને ચૂકવેલી રકમ સુધી મર્યાદિત છે
• Force majeure ને કારણે service interruptions માટે અમે જવાબદાર નથી

૧૦. Indemnification

તમે આ Terms ના ઉલ્લંઘન અથવા Service ના દુરુપયોગથી ઉદ્ભવતા કોઈપણ claim, loss, અથવા damage (reasonable કાનૂની ફી સહિત) સામે Purush Shakti, તેના operator, અને third-party providers ને indemnify કરવા સંમત છો.

૧૧. Termination

જો અમે માનીએ કે તમે Terms નું ઉલ્લંઘન કર્યું છે, તો અમે ગમે ત્યારે, સૂચના સાથે અથવા સૂચના વગર, Service ની તમારી ઍક્સેસ સ્થગિત અથવા સમાપ્ત કરી શકીએ છીએ. તમે ગમે ત્યારે subscription cancel કરી અને એપ uninstall કરી Service નો ઉપયોગ બંધ કરી શકો છો.

૧૨. કાનૂની અધિકારક્ષેત્ર

આ Terms ભારતના કાયદાથી નિયંત્રિત છે. કોઈપણ વિવાદ અમદાવાદ, ગુજરાત, ભારત ની કોર્ટ ના exclusive jurisdiction હેઠળ રહેશે.

૧૩. વિવાદ નિવારણ

કાનૂની કાર્યવાહી પહેલા, બંને પક્ષો good-faith negotiation દ્વારા સમાધાન કરવા સંમત છે. ૩૦ દિવસમાં અણઉકેલાય તો, વિવાદ Arbitration and Conciliation Act, ૧૯૯૬ હેઠળ અમદાવાદમાં sole arbitrator દ્વારા, અંગ્રેજીમાં arbitration ને referred કરવામાં આવશે.

૧૪. Terms માં ફેરફાર

મહત્વપૂર્ણ ફેરફારોની જાણ ઓછામાં ઓછા ૭ દિવસ પહેલા એપ અથવા ઇમેઇલ દ્વારા આપવામાં આવશે. અમલમાં આવ્યા પછી પણ ઉપયોગ ચાલુ રાખવાથી revised Terms ની સ્વીકૃતિ માનવામાં આવશે.
